US court finds no antitrust violations in Wabtec–GE Transportation merger

USA: The US Delaware District Court has dismissed an antitrust lawsuit against Wabtec, filed by Progress Rail in 2023. The court rejected all antitrust allegations, concluding that the transaction did not harm competition.

Progress Rail had accused Wabtec of abusing its dominant position in the mainline locomotive market, as well as in related control systems and services, and of damaging Progress Rail’s business reputation. According to Progress Rail, Wabtec accounted for 71% of all mainline diesel locomotives delivered in North America over the past decade, and held a 90% share of the US Tier IV-compliant locomotive market.

The assets at the centre of the dispute were acquired by Wabtec from General Electric in 2019 for $11 bln, including locomotive manufacturing plants in Erie and Fort Worth, as well as a diesel engine facility in Grove City.
